Report about the trial of the lawyer
Mohammed Al-Tajer
The
lawyer Mohammed Al-Tajer has attended in front of the third minor criminal
court on November 22, 2011due to his accusation during the period of national
safety. The trial was postponed to February 7, 2012 for hearing witnesses on
his behalf.
The
lawyer Mohammed Al-Tajer was arrested on April 15, 2011 after raiding his house
and confiscating his personal and work items such as laptops, documents, and
mobile phones as well as his office keys.
He was kept in
detention for 114 days, where he was ill treated and tortured. He was kept in
solitary confinement for seven week.
On 12 June, Mohammed al-Tajer was brought before the
National Safety Court, (a military court) of First Instance. There were no one
of his family member or his lawyers informed about the trial.
Some lawyers who were in the court that day and saw
him informed the judge that they wanted to represent him. He was charged with offences that include
spreading rumours and malicious news and incitement of hatred towards the
regime. He has pleaded not guilty.
On 16 June he was brought again before the National
Safety Court, about 50 lawyers had attended the session with him.
The defence confirmed in an oral argument, the
invalidity of the investigation of the military prosecution against him, noting
that the case papers were free of an order of referral, and the lack of arrest
warrant.
Al-Tajer denied the signature on some of the documents
referred to prosecution, which was clearly shown the difference between both
signatures.
The defence also confirmed that their client “Al-Tajer
“didn’t violate the law in the issue of a licensed assembly in the Pearl
Roundabout , which lasted for more than a month with the permission from the
king and his crown, and by the knowledge and protection of the security
services. In that assembly Al-Tajer as well as the others had exercised one
right of his constitutional rights.
The defence refused the charges of spreading rumours
and false news and inciting hatred as it was based on ALALAM interview which
didn’t have any of the words recorded in the file case.
In spite of his release on middle of august
Al-Tajer still didn’t receive any of his
confiscated items which contain a lot of his client’s information’s which
affect the confidentiality of his work, and some of the confiscated items
contain personal pictures and videos of his family.
Al-Tajer complains that he is still on close
monitoring of his phones and movements. Even his clients are under pressure of
not to assign him a new cases. He also complained that still there are a lot of
incite sectarianism and treasons words against him in their forums.
He fears the consequences of continuing the
trial in the presence of the same national safety court sentences.
Al-Tajer would like to express his profound
appreciation and gratitude to all whom contributed to his release and improve
his treatment during detention and to whom supported his family.
